Welcome, and thank you for your interest in Gravity Industries Ltd (“Gravity,” “we,” or “us”) and our website at www.gravity.co (“Website”). These Terms of Use are a legally binding contract between you and Gravity regarding your use of our “Services”.

Who Can Fly –; general; law; indemnity?

Pilot Candidates may be as young as 12 years old, with prior approval by Gravity upon checking safety requirements are met. Younger clients are able to participate subject to written parental/guardian consent and appropriate physical condition. Children under 18 years of age need to have a parent or guardian to sign the waiver supplied by Gravity. There is no upper age limit. All Pilot Candidates must be in good health and physical condition and willing to self declare. In order to provide a safe experience for Pilot Candidates and instructors, Gravity may not be able to accommodate any Pilot Candidate who weighs between 95kg – 125kg; we ask clients to inform the booking assistant of current body weight and an additional evaluation by a Gravity staff member upon arrival will be required to determine whether the Pilot Candidate can be accommodated. If you have a current or prior head, neck, back or shoulder injury, heart condition, or any other condition that may impede your ability to take part in physical activity or increase the risk of injury, you should seek medical advice prior to undertaking this activity, and in some cases a doctor’s note may be required. Management reserves the right to refuse service to anyone at any time. Additional restrictions may apply.

Waiver

All Pilot Candidates must complete the Waiver, a legal contract between the Pilot Candidate and Gravity. This contract ensures all Pilot Candidates understand the nature of the activity, and the risks involved. All information retained on the Waiver is used for this purpose alone and will not be supplied to any other party for any other purpose, except where authorized by the customer. As a legal contract, it must be completed accurately by the Pilot Candidate or parent/guardian as applicable. Refusal to complete the Waiver will result in the inability to participate. The Waiver must be completed online prior to commencement of the activity. A copy of the waiver can be requested upon booking. Parents of children under 18 must provide identification to validate their right to execute the contract on behalf of the child Pilot Candidate.

Bookings

Please follow the Joining Instructions sent to you ahead of your booking. If you have any queries please contact our office and/or your Point of Contact for clarification. In order to fly, the customer is responsible for arriving in time to complete necessary paperwork and must be:

Must complete a Waiver

Cancellation and Rescheduling Policy: At least 48-hours prior notice required to reschedule. We require two weeks’ notice for a refund to be provided. Without sufficient notice, reservations are non- refundable in full (including the deposit).

As a courtesy, Gravity may accommodate late rescheduling requests, but shall do so at its sole discretion, reserving its rights. Such reservations may only be rescheduled under the same terms as the original reservation’s pricing and applicable restrictions. Reservations rescheduled within 48-hours of original reservation date are no longer eligible for a refund. Gravity cannot be held responsible for missed reservations as a result of extenuating circumstances such as transportation, weather, nor any other reason outside of the control of Gravity.

Large Groups and Events: For group bookings, the deposit is due at time of booking and final payment is due 7 days prior to the event. Reservations will be cancelled automatically if final payment has not been collected 7 days prior to the event and we have been unable to contact the client. The deposit shall always remain non-refundable. The remaining balance payments are refundable if cancelled at least 14 days prior to the event. Cancellations less than 7 days prior to the event will forfeit the deposit and all other payments made towards the event.

Unexpected Maintenance

Our best effort is made to ensure all reservations can be honoured. The Gravity Jet Suit is a piece of cutting-edge technology, which may occasionally require unexpected maintenance. Reservations cancelled by Gravity will be refunded or rescheduled based on availability and customer preference.

Personal Items

Gravity will not be held responsible for the loss or theft of any items on the premises. We encourage our customers to leave all items of value at home or with a trusted spectator during flight sessions.

Customer Responsibilities

Customer is responsible for the use of their personal information with regards to setting, changing, or cancelling reservations.

Refund Policy

The deposit paid in relation to purchases of Flight Training Days, Experience Days and Gift Certificates are non-refundable unless otherwise specified in the terms of a particular offer. The remainder of the fee is refundable, subject to our Cancellation and Rescheduling Policy.
